As per Amendment in 2020Name, Address, Flag, Emblem & Central Office
- (a)Name: The name of the organization shall be North East India Emarat e Shariah and Nadwatut Tameer.
- (b)Address: The Central Office shall be situated at Mission Road, P.O. Badarpur, Karimganj, Assam – 788806.
- (c)Flag: The North East India Emarat e Shariah and Nadwatut Tameer shall have its own flag. The upper one-third portion of the flag shall be black, and the lower two-thirds shall be white in colour. In the white portion, there shall be an image of the Holy Ka'bah. The width of the flag shall be two-thirds of its length.
- (d)Significance of the Flag and Its Colours:
The black colour symbolizes the eradication of all forms of superstitions from society.
The white colour represents truth, non-violence, and cordial and fraternal relations with other institutions.
The image of the Holy Ka'bah signifies the primary objective of North East India Emarat e Shariah and Nadwatut Tameer, which is to promote the fundamental teachings of Islam, Islamic culture, and civilization based on the Holy Qur'an and Sunnah. The Ka'bah, being the first house of worship created by the Almighty and the greatest spiritual centre of the Muslim world, represents the foundation of Islamic education, universal brotherhood, and love for humanity. - (e)Central Office: The Central Office of North East India Emarat e Shariah and Nadwatut Tameer shall be located at Badarpur. However, if necessary, it may be shifted to any other place by the decision of the Central Majlis-e-Shura.
- (f)Emblem: North East India Emarat e Shariah and Nadwatut Tameer shall have its own emblem. The emblem shall consist of the name of the organization written in a circular form, within which the crossed flags of the organization shall be depicted. The primary objective of the emblem is to convey the message of Islam throughout the world.
Objectives
- (a)To establish an organized working body (Amal Jama'at) for implementing essential educational and social programmes aimed at shaping life in accordance with Islamic culture and civilization, as guided by the Holy Qur'an and Sunnah, while remaining within the framework of the Constitution of India.
- (b)To promote and enhance religious education among Muslims on the basis of the Holy Qur'an and Sunnah; to eradicate social evils; and to establish Islamic primary, secondary, higher, and advanced educational institutions. Furthermore, to develop a complete Islamic educational system aimed at producing self-reliant individuals grounded in Islamic values, culture, and civilization, and committed to true nationalism and harmony.
- (c)Under the supervision of North East India Emarat e Shariah and Nadwatut Tameer, there shall be a structured educational system starting from Sabahi (primary) Maktab up to the highest level, i.e., Title Part-IV. Any Madrasa wishing to conduct education under this syllabus must obtain approval from the Central Majlis-e-Shura and comply with all regulations of the Central Nadwa. Such institutions shall be recognized as Nadwatut Tameer Madrasas.
At present, the first, second, and fourth sections of Al-Jamiatul Arabiatul Islamia, popularly known as Deorail Title Madrasa, are being conducted under the Nadwa syllabus, and the salaries of teachers of Title Part-I and Part-II are provided by the government.
The Nadwatut Tameer reserves the right to modify the curriculum of all levels when necessary. The Education Board constituted by the Central Nadwa shall supervise the proper functioning of the education system and conduct examinations.
The Islamic educational institution operating under the supervision and syllabus of North East India Emarat e Shariah and Nadwatut Tameer shall have its own flag. The flag shall be completely white in colour, bearing the image of the Holy Masjid-e-Nabawi. The width of the flag shall be two-thirds of its length.
Significance of the Flag:
The white colour symbolizes truth, non-violence, and cordial relations with other institutions.
The image of Masjid-e-Nabawi represents the core objective of Al-Jamiatul Arabiyatul Islamia to impart complete Islamic education based on the Qur'an and Sunnah, to shape lives in accordance with the exemplary model of the noble Companions, and to establish peace, justice, and righteousness in society. - (d)To preserve Islamic culture and civilization.
- (e)To promote unity, harmony, mutual cooperation, and national integration among the diverse communities of India through the teachings of Islam, and to take necessary steps to strengthen these values.
- (f)To revive and reform Islamic education in India, which had been deliberately distorted during the British period, and to restore it to its authentic and comprehensive form.
- (g)To undertake welfare-oriented activities and, through constructive programmes, enable the general public to become self-reliant.
- (h)To establish Sabahi Maktabs in every Muslim locality across North-East India in accordance with the syllabus prescribed by North East India Emarat e Shariah and Nadwatut Tameer, in order to impart basic and essential Islamic education to Muslim boys and girls. In addition, to establish night Madrasas for adults.
- (i)To eradicate the practice of begging in society and, through the establishment of a Baitul Maal, provide financial assistance to poor, deserving students and the needy, and to collect and distribute obligatory and voluntary charity in accordance with the injunctions of Shariah.
- (j)To eliminate social evils prevalent in Muslim society and to promote a healthy social life by appointing Qazis (judicial authorities) at various levels for the settlement of disputes—especially matters relating to Muslim Personal Law such as marriage, divorce, waqf, will (wasiyyah), and khula—in accordance with the injunctions of Shariah.
- (k)To mould every Muslim into an ideal believer through a Qur'an- and Sunnah-based way of life by organizing programmes of Tabligh, Tafsir, Khanqah activities, and Halqah-e-Zikr for all sections of society.
- (l)To organize seminars, discussions, and awareness programmes on contemporary issues related to Islamic education and culture.
- (m)To publish and disseminate Islamic and social reformative books and textbooks.
- (n)To form a Yuba Nadwa for inspiring the Yuba towards Islamic education and culture and motivating them to dedicate themselves to the service of Deen.
Jurisdiction
The jurisdiction of North East India Emarat e Shariah and Nadwatut Tameer shall extend over the seven states of North East India, namely Assam, Meghalaya, Tripura, Nagaland, Manipur, Mizoram, and Arunachal Pradesh.
If residents of any other part of the Republic of India, being inspired by the activities of North East India Emarat e Shariah and Nadwatut Tameer, desire to establish branches of Imarat-e-Shariyah and Nadwatut Tameer in their respective areas in accordance with its constitution, they may do so with the approval of the Central Majlis-e-Shura.
Eligibility for Membership
Members of North East India Emarat e Shariah and Nadwatut Tameer shall be of two categories, namely: (a) Active Members and (b) General Members.
- (a)Any person who agrees with the objectives of Imarat-e-Shariyah wa Nadwatut Tameer and expresses faith therein by signing the prescribed declaration form, pledging to work for the organization, shall be considered a General Member. Such members shall not be entitled to participate in elections or nominations. However, after remaining active as a General Member for at least three years and upon proving sincerity and dedication to the organization, such a member may, with the approval of the Ameer e Shariat, be granted the status of an Active Member and thereby become eligible to participate in elections and nominations.
- (b)The first Ameer e Shariat of North East India and the succeeding Amirs-e-Shari'at, along with other Mashayikh, shall be considered Active Members of Imarat-e-Shariyah wa Nadwatut Tameer. Only Active Members shall be entitled to participate in elections and nominations.
- (c)Where residents of any area express willingness to form a Anchalik committee but no Active Member exists in that area, then, for the purpose of forming such a unit, a list of interested and trustworthy persons may be prepared and, upon approval of the Centre, such persons shall be considered Active Members for organizational purposes.
Duties and Responsibilities of Members
- (a)To make sincere efforts toward the realization of the objectives of Imarat-e-Shariyah wa Nadwatut Tameer.
- (b)To regularly and voluntarily contribute the prescribed subscription in a timely manner.
- (c)To participate in constructive activities according to one's capability.
- (d)To take part in the organized dissemination of Islamic education for children through Sabahi Maktabs.
- (e)To establish Shabina Madrasas (night schools) for providing religious education to adults.
- (f)To cultivate a character based on the Sunnah, serving as a model for others.
- (g)To arrange Tafsir (exegesis) of the Holy Qur'an at various places.
- (h)To motivate and mobilize the Yuba by forming and strengthening Yuba Nadwa units.
Grounds for Cancellation of Membership
- (a)If it is proven that a member lacks sincere commitment to the objectives and programmes of Imarat-e-Shariyah wa Nadwatut Tameer, or is involved in activities contrary to Islamic principles and detrimental to the organization, the Ameer e Shariat may, upon the decision of the Majlis-e-Shura, cancel such membership.
- (b)If an Active Member fails to pay the prescribed subscription or remains inactive for a continuous period of three years.
- (c)If a member violates the constitution or by-laws of Imarat-e-Shariyah wa Nadwatut Tameer, the Ameer e Shariat may cancel such membership based on the recommendation of the Central Disciplinary Committee constituted by him.
Organizational Structure
North East India Emarat e Shariah and Nadwatut Tameer shall have a Central Committee, under which the following committees shall function:
- (a)Anchalik Committee
- (b)District Committee
- (c)State Committee
The names of the Anchalik, district, and state committees shall be determined according to the respective regions, districts, and states.
Tenure of Committees
- (a)The tenure of the Majlis-e-Shura (Executive Council) and Majlis-e-Muntazima (Administrative Committee) at every level shall be five years.
- (b)If, for any reason, the formation of a new committee is delayed, the existing committee may continue to function for a maximum period of six months with the approval of the Majlis-e-Shura.
- (c)Ex-officio members shall be counted as part of the total membership of the respective committees.
Formation of Committees — Anchalik Committee
- (a)A Anchalik Committee shall be formed in any area where at least twenty-five Active Members are available. In exceptional cases, even if Active Members are not available, a Anchalik Committee may be constituted in accordance with Clause 4(c).
- (b)Each Anchalik Committee shall have a Majlis-e-Shura (Executive Council).
- (c)The Majlis-e-Shura shall consist of not less than thirteen and not more than seventeen members, including office-bearers.
- (d)Active Members of the Anchalik shall be considered members of the Majlis-e-Muntazima (Executive Committee). The list of members of the Majlis-e-Muntazima shall be approved by the Ameer e Shariat. The members of the Majlis-e-Muntazima, in the presence of a nominated observer, shall elect from among themselves the President and other office-bearers of the Anchalik Majlis-e-Shura, and forward the same for approval to the Ameer e Shariat through the Central Secretary.
- (e)The Anchalik Committee shall consist of the following office-bearers:
- 1.President – One
- 2.Vice-President – One
- 3.Secretary – One
- 4.Assistant Secretary – One
- 5.Publicity Secretary – One
- (f)The following shall be ex-officio members of the Anchalik Majlis-e-Shura:
- 1.Anchalik Qazi
- 2.Anchalik Sabahi Maktab Inspector
- 3.Anchalik Muallim
- 4.Vice-President of the Anchalik Yuba Nadwa
- 5.Secretary of the Anchalik Yuba Nadwa
District Committee
- (a)There shall be a District Committee in each district under North East India Emarat e Shariah and Nadwatut Tameer. In special circumstances, more than one District Committee may be formed in a district with the approval of the Ameer e Shariat upon the recommendation of the Election Sub-Committee.
- (b)Each District shall have a Majlis-e-Muntazima (Executive Committee). The nominated representatives from the regions shall be members of the District Majlis-e-Muntazima. The committee shall consist of not less than twenty-five members.
- (c)From among the active members of the region, one representative for every twenty-five members, and one additional member for every additional twelve members, shall be nominated to the District Majlis-e-Muntazima.
- (d)The nominated members of the District Majlis-e-Muntazima may recommend up to five names for co-option as members. In addition, seven members shall be nominated by the Ameer e Shariat.
- (e)The District Committee office shall ordinarily be located at the district headquarters. In special circumstances, it may be located elsewhere with the approval of the Ameer e Shariat.
- (f)For administrative convenience, the District Majlis-e-Shura may divide its jurisdiction into zones and appoint one coordinator for each zone.
- (g)The District Majlis-e-Shura shall consist of not less than nineteen and not more than twenty-five members, including the following office-bearers:
- 1.President – One
- 2.Vice-President – Two
- 3.General Secretary – One
- 4.Secretary – Three
- 5.Publicity Secretary – One
- (h)The District Majlis-e-Muntazima shall recommend the names of the office-bearers and members of the District Majlis-e-Shura for approval by the Ameer e Shariat in the presence of the nominated observer.
- (i)The following shall be ex-officio members of the District Majlis-e-Shura:
- 1.District Qazi
- 2.District Sabahi Maktab Inspector
- 3.District Muallim
- 4.Vice-President of District Yuba Nadwa
- 5.General Secretary of District Yuba Nadwa
State Committee
- (a)In each state under North East India Emarat e Shariah and Nadwatut Tameer (except Assam), there shall be a State Committee. Each state shall have its own Majlis-e-Muntazimah (Executive Committee).
- (b)After new nominations, the District Majlis-e-Muntazimah shall recommend one-third of its total members for nomination to the State Majlis-e-Muntazimah, subject to the approval of the Ameer e Shariat. The President and General Secretary of each district shall be ex-officio members of the State Majlis-e-Muntazimah.
- (c)The nominated members of the State Majlis-e-Muntazimah may recommend eleven persons for co-option as members. In addition, nine members shall be nominated by the Ameer e Shariat.
- (d)There shall be a State Majlis-e-Shura. The number of members of the Shura, including office-bearers, shall not be less than twenty-one and not more than twenty-seven. The State Majlis-e-Muntazimah shall, in the presence of an appointed observer, recommend the names of office-bearers and members of the State Majlis-e-Shura for approval by the Ameer e Shariat.
- (e)The following office-bearers shall constitute the State Committee:
- 1.President – One
- 2.Vice-President – Two
- 3.General Secretary – One
- 4.Secretary – Three
- 5.Publicity Secretary – One
- (f)The following shall be ex-officio members of the State Majlis-e-Shura:
- 1.State Qazi-e-Shari'at
- 2.State Sabahi Maktab Inspector
- 3.State Muallim
- 4.State Yuba Nadwa Vice-President
- 5.State Yuba Nadwa General Secretary
North East India Emarat e Shariah and Nadwatut Tameer — Central Committee
- (a)After new nominations, the State Majlis-e-Muntazimah shall recommend one-third of its total members, and one-fifth of the members from each district of Assam, for nomination to the Central Majlis-e-Muntazimah of North East India Emarat e Shariah and Nadwatut Tameer. The Presidents and General Secretaries of all states and districts shall be ex-officio members of the Central Majlis-e-Muntazimah.
- (b)The Ameer e Shariat may nominate fifteen additional members to the Central Majlis-e-Muntazimah.
- (c)There shall be a Central Majlis-e-Shura of North East India Emarat e Shariah and Nadwatut Tameer. The total number of members, including office-bearers, shall be not less than forty-one and not more than fifty-one. The Central Majlis-e-Muntazimah shall submit the list of office-bearers and members for approval by the Ameer e Shariat.
- (d)The following shall be the office-bearers of North East India Emarat e Shariah and Nadwatut Tameer:

- 2.Nayeeb Ameer e Shariat (Vice-President) – One
- 3.Nazim-e-A'la (General Secretary) – One
- 4.Secretaries – Thirteen
- (e)The following shall be ex-officio members of the Central Majlis-e-Shura:

- 3.One Central Muallim
- (f)The following departments shall function under the Central Majlis-e-Shura:

- (g)The Ameer e Shariat shall, in consultation with the Nayeeb Ameer e Shariat and the General Secretary, assign the responsibilities of the above departments.
- (h)For effective functioning, the Central Majlis-e-Shura shall constitute the following committees and advisory boards for specified terms:
- 1.Baitul Mal Committee
- 2.Education Committee
- 3.Khanqah Committee
- 4.Publication Committee
- 5.Neda-e-Deen Advisory Board
- 6.Disciplinary Committee
- 7.Planning Committee
- 8.Nadwa Welfare Society
Youth Wing
To awaken the Youth to their responsibilities towards society and to implement the objectives of Emarat-e-Shariah and Nadwatut Tameer, a Youth Wing named Yuba Nadwatut Tameer shall function under its supervision.
This wing shall have its own constitution, which shall become effective upon approval by the Central Majlis-e-Shura. It shall function up to the state level and shall be headed by a Central Secretary.
Quorum
- (a)For meetings of all levels of the Majlis-e-Shura, the presence of at least one-third of the total members shall constitute a quorum.
- (b)For meetings of the Majlis-e-Muntazimah, the presence of at least one-fifth of the total members shall constitute a quorum.
Meetings
- (a)At least one meeting of the Majlis-e-Muntazimah shall be held every year at each level.
- (b)At least four meetings of the Majlis-e-Shura shall be held every year.
- (c)Notice of at least twenty-one days shall be given for meetings of the Majlis-e-Muntazimah, and at least fifteen days' notice for meetings of the Majlis-e-Shura. In urgent situations, meetings may be convened immediately with the permission of the Chairman.
- (d)At least once every year, a general session of North East India Emarat e Shariah and Nadwatut Tameer shall be held. Additionally, conferences, workers' conventions, and training camps may be organized as deemed necessary by the Central Majlis-e-Shura.
Election of the Ameer e Shariat
- (a)A person possessing sound Islamic knowledge, deep religious insight, commitment to Islamic values, and proven dedication to eliminating un-Islamic practices, and who is recognized by the members of Arbab-e-Hall wa Aqd approved by the Central Majlis-e-Shura, shall be eligible to be elected as Ameer e Shariat.
- (b)For the election of the Ameer e Shariat, the Central Majlis-e-Shura shall prepare a list of members of Arbab-e-Hall wa Aqd. A meeting of these members shall be convened by the General Secretary, and from among eligible candidates they shall elect the Ameer e Shariat in accordance with Shari'ah principles. The Vice-Ameer e Shariat shall preside over the election session.
- (c)There shall be one Nayeeb Ameer e Shariat, appointed by the Ameer e Shariat.
- (d)In the event of a vacancy in the office of the Ameer e Shariat, the Nayeeb Ameer e Shariat shall function as Acting Amir until a new Amir is elected in accordance with Article 16(b) within three months.
Establishment of Darul Qaza and Appointment of Qazis
- (a)There shall be a Central Darul Qaza under North East India Imarat-e-Shariyah. Three Qazis shall serve therein, and the Ameer e Shariat shall be the Chief Qazi (Qazi-ul-Quzat). The Central Qazis shall be appointed by the Ameer e Shariat in consultation with the Central Majlis-e-Shura.
- (b)Each state shall have a State Darul Qaza comprising one Chief Qazi and three Deputy Qazis.
- (c)Each district shall have a District Darul Qaza consisting of one Qazi and two Deputy Qazis.
- (d)Each region shall have a Anchalik Darul Qaza with one Qazi and, if required, one Deputy Qazi.
- (e)Appointment of Qazis and Deputy Qazis shall be based on sound Islamic knowledge, moral integrity, and competence. Preference shall be given to those possessing recognized Islamic qualifications. In exceptional cases, the Ameer e Shariat may appoint a suitable person at his discretion.
- (f)All Qazis and Deputy Qazis shall be appointed solely by the Ameer e Shariat. No other authority shall have the power of appointment. The Ameer e Shariat may consult the concerned Majlis-e-Shura when necessary.
- (g)No individual may simultaneously hold the position of Qazi or Deputy Qazi at more than one level.
- (h)Appeals against the decisions of any Darul Qaza may be submitted to the higher Darul Qaza within ninety days. The decision of the Qazi-ul-Quzat (Ameer e Shariat) shall be final.
- (i)The Ameer e Shariat shall have the authority to remove any Qazi from office.
- (j)Qazis under North East India Imarat-e-Shariyah may register marriages and issue certificates in accordance with prescribed rules and shall provide certified copies to the concerned parties.
Powers and Duties of the General Secretary / Anchalik Secretary
- (a)To supervise and implement the multifaceted activities of the organization and to prepare necessary plans for approval by the Majlis-e-Shura.
- (b)To convene meetings of the Majlis-e-Muntazimah and Majlis-e-Shura in due time, maintain minutes, and ensure implementation of decisions.
- (c)To operate joint bank accounts in the name of the organization along with the President/Ameer e Shariat for deposit and withdrawal of funds.
- (d)To arrange annual auditing of accounts and submit the audited statement to the Majlis-e-Shura for approval.
- (e)To prepare and present the annual budget at the first meeting of the year for approval.
- (f)To maintain proper records, documents, movable and immovable properties, and ensure orderly administration.
- (g)To supervise the functioning of organizational staff and ensure discipline.
- (h)To obtain prior approval of the Majlis-e-Shura for any expenditure beyond the sanctioned budget, except in emergencies where approval of the Ameer e Shariat shall suffice, subject to later ratification.
- (i)To collect obligatory and voluntary donations and deposit them in Baitul Mal, ensuring proper utilization in accordance with Shari'ah.
- (j)To supervise the work of subordinate secretaries and ensure effective performance.
- (k)The General Secretary shall act as the official spokesperson of the organization.
Duties of Secretaries and Assistant Secretaries
- (a)To assist the General Secretary in the discharge of official duties.
- (b)To undertake responsibilities assigned by the Majlis-e-Shura and to ensure effective implementation of assigned tasks.
- (c)To maintain proper records and documentation of their respective departments.
- (d)To prepare annual reports of their respective departments and submit them to the General Secretary for presentation before the Majlis-e-Shura.
- (e)In the absence or incapacity of the General Secretary, any Secretary may be authorized by the Ameer e Shariat to discharge the duties of the General Secretary.
Duties of Qazis
- (a)To resolve disputes relating to marriage, divorce, inheritance, and other personal law matters in accordance with Islamic law.
- (b)To provide guidance on religious rites and practices.
- (c)To solemnize marriages and perform other religious ceremonies when approached.
- (d)To discharge all duties assigned under Shari'ah as Qazi of the organization.
- (e)To maintain proper records of their official work and issue necessary certificates when required.
- (f)To register marriages and issue certificates in accordance with prescribed procedures.
- (g)Deputy Qazis shall assist the Qazis in the discharge of their duties.
Appointment of Inspectors and Muallims
- (a)For the proper functioning of Sabahi Maktabs, there shall be one Inspector each at the Anchalik, district, state, and central levels. The concerned Majlis-e-Shura shall appoint the Inspectors. Where necessary, one or more Assistant Inspectors may also be appointed. By virtue of office, the Inspector shall be a member of the concerned Majlis-e-Shura.
- (b)For the effective operation of the Talqeen (instructional) department, one Muallim shall be appointed at each level from Anchalik to central. Such appointments shall be made by the Ameer e Shariat, who may consult the concerned Shura if deemed necessary. By virtue of office, the Muallim shall be a member of the respective Shura.
Resignation, Vacancy, and Inability to Perform Duties
- (a)Any office-bearer or member wishing to resign shall submit a written resignation addressed to the General Secretary through the concerned Shura. In the case of an Area Secretary or General Secretary, the resignation shall be addressed to the President of the respective Shura.
- (b)Any Qazi, Nayeeb Qazi, or Muallim intending to resign shall submit a written resignation addressed to the Ameer e Shariat, with a copy forwarded to the concerned Shura.
- (c)In case of resignation or vacancy for any reason, the concerned Shura shall convene a meeting and take necessary steps in accordance with the constitution.
- (d)If any office-bearer or member becomes incapable of discharging his duties, he shall voluntarily relinquish his position. Failing which, appropriate action shall be taken by the competent authority in the interest of the organization.
Collection of Funds
- (a)The financial year shall be from 1st April to 31st March.
- (b)Every year, in the first half of April, the respective Secretary or General Secretary shall present the statement of income and expenditure of the previous financial year before the concerned Majlis-e-Shura.
- (c)Every active member shall pay the prescribed annual membership fee as fixed by the Central Majlis-e-Shura. The Ameer e Shariat may reduce or waive the fee considering individual circumstances.
- (d)Of the annual membership fees collected, one-fourth shall remain with the Anchalik unit, and the remaining amount shall be deposited with the district. From the amount received by the district, one-third shall remain with the district and the remaining shall be forwarded to the state level. From the amount received by the state, half shall remain with the state and the remaining half shall be deposited with the Central body. For districts directly under the Central authority, one-third of the collection shall remain with the region and the remaining shall be deposited with the district, from which half shall go to the central fund.
- (e)Funds may also be raised through other lawful means as approved by the Central Majlis-e-Shura.
- (f)All collections shall be made only through authorized receipts.
- (g)For construction of offices, operation of khanqahs, or organization of conferences, prior permission must be obtained—Anchalik committees from the district, district committees from the state/central body, and state committees from the central authority.
- (h)If the monthly income from movable or immovable property of any unit exceeds ₹5,000, half of the excess amount shall be deposited with the Central office. Of the remaining amount, 30% shall be retained by the Anchalik unit and 10% by the district unit.
- (i)If any movable or immovable property belongs directly to the Central Imarat, 70% of the income shall be deposited with the Central office and the remaining 30% shall be retained by the appointed custodian. The collected amount shall be remitted within the stipulated time.
Baitul Maal
- (a)A Baitul Maal shall function under North East India Emarat e Shariah and Nadwatut Tameer for the welfare of the poor and needy. The Central Majlis-e-Shura shall constitute a committee to manage the Baitul Maal. The Secretary of the Baitul Maal shall serve as the Secretary of the committee.
- (b)Funds collected in the Baitul Maal shall be distributed in accordance with the decisions of the Baitul Maal Committee. Eighty percent (80%) shall be disbursed within the respective region, while the remaining twenty percent (20%) shall be allocated as follows: five percent (5%) shall remain with the Ameer e Shariat for charitable distribution, and the remaining fifteen percent (15%) shall be distributed among the needy as determined by the committee.
Ownership of Property
Any immovable property acquired by any branch of North East India Emarat e Shariah and Nadwatut Tameer shall be registered in the name of the organization through the Ameer e Shariat.
Appointment of Auditors
- (a)The Majlis-e-Shura at every level shall appoint one or more auditors to audit the annual accounts. The audit report shall be submitted to the respective Majlis-e-Shura for approval.
- (b)Copies of audit reports shall be forwarded from the Anchalik office to the district office, from the district office to the state office, and from the state office to the central office.
- (c)The superior bodies of Emarat and Nadwatut Tameer shall have the authority to inspect accounts and records of subordinate units either with prior notice or without notice.
Appointment of Employees
With the approval of the Ameer e Shariat, the General Secretary may appoint staff for the Central Office of Emarat-e-Shariah and Nadwatut Tameer. The qualifications and remuneration of such employees shall be determined by the Central Majlis-e-Shura. The Chief Employee shall function as the Office Secretary with the approval of the Majlis-e-Shura.
Dissolution of the Organization
- (a)North East India Emarat e Shariah and Nadwatut Tameer is a religious organization. Except in accordance with Islamic principles, it cannot be dissolved. Dissolution may take place only with the unanimous decision of the members of Ahl-e-Hall wal Aqd, and shall be executed by the Ameer e Shariat.
- (b)A list of members of Ahl-e-Hall wal Aqd approved by the Central Majlis-e-Shura shall be maintained.
- (c)In the event of dissolution, after settlement of all liabilities, the remaining assets shall be transferred to another suitable institution in accordance with the decision of at least three-fourths of the members of the Central Majlis-e-Muntazimah.
Legal Proceedings
The Ameer e Shariat and the Amir of Nadwatut Tameer shall be authorized to institute or defend legal proceedings on behalf of the organization.
Amendment of the Constitution
The power to amend, modify, or repeal any provision of this Constitution shall vest in the Central Majlis-e-Muntazimah of North East India Emarat e Shariah and Nadwatut Tameer.
